Terms of Service

Please read these Terms of Service ("Terms") carefully as they contain important information about your legal rights, remedies, and obligations. By accessing or using the LeaseMe Platform, you agree to comply with and be bound by these Terms.

These Terms constitute a legally binding agreement ("Agreement") between you and LeaseMe, LLC, a Florida limited liability company ("LeaseMe," "we," "us," or "our"), governing your access to and use of the LeaseMe website, including any subdomains, and any other websites, mobile applications, or services through which LeaseMe makes its services available (collectively, the "LeaseMe Platform"). Our Privacy Policy and other policies applicable to your use of the LeaseMe Platform are incorporated by reference into these Terms.

IMPORTANT NOTICE: LeaseMe is a technology platform only. LeaseMe does not own, lease, manage, broker, or insure any property. LeaseMe does not provide legal advice, real estate brokerage services, escrow services, or money transmission services. All rental or sublease arrangements are made directly between users.

1. Scope of LeaseMe Services

1.1 Marketplace Platform

The LeaseMe Platform is an online marketplace that enables registered users ("Users") to publish listings for subleases ("Listings") and to communicate and transact directly with other Users seeking to book such Listings ("Guests"). Users who publish Listings are referred to as "Hosts."

1.2 No Ownership, Brokerage, or Legal Services

LeaseMe does not own, create, sell, resell, provide, control, manage, offer, or supply any Listings. Hosts alone are responsible for their Listings. When Users make or accept a booking, they enter into a contract directly with one another. LeaseMe is not a party to any agreement between Users and is not a real estate broker, agent, fiduciary, landlord, tenant, or insurer. LeaseMe is not obligated to mediate any dispute between a Host and a Guest.

LeaseMe is not a law firm and does not provide legal services or legal advice. Users are encouraged to consult a licensed Florida attorney before entering into any sublease transaction.

1.3 No Guarantees

LeaseMe does not guarantee the existence, quality, safety, legality, suitability, or accuracy of any Listings, User Content, or User conduct. Any verification, including university email verification or student enrollment verification, is provided solely for informational purposes and does not constitute endorsement or certification. LeaseMe does not verify whether a Host has obtained any required consent from their landlord or property manager to sublet the listed property.

1.4 Independent Parties

Hosts and Guests act independently and exclusively on their own behalf. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between LeaseMe and any User.

2. Eligibility and Account Registration

2.1 Eligibility

You must be at least 18 years old and capable of entering into legally binding contracts to use the LeaseMe Platform. Use of the LeaseMe Platform is currently limited to individuals who can verify their current enrollment or recent attendance at an accredited college or university ("Student Verification"). By completing Student Verification, you represent and warrant that the information provided is accurate and complete. Providing false information to satisfy the Student Verification requirement is a material breach of these Terms and may result in immediate account suspension, forfeiture of any pending transactions, and potential legal liability.

2.2 Account Creation

To access certain features, you must register a LeaseMe account and provide accurate, complete, and current information. You may not register more than one account without express authorization from LeaseMe. To delete your account, please contact us through the LeaseMe Platform. Account deletion does not affect obligations arising from transactions completed prior to deletion.

2.3 Account Security

You are responsible for safeguarding your login credentials and all activity conducted through your account. You must notify LeaseMe immediately of any unauthorized access to or use of your account. LeaseMe reserves the right to share account information with law enforcement, regulators, or other government authorities as required by applicable law or legal process.

3. Listings

3.1 User Responsibilities

Users who post Listings are solely responsible for ensuring that their Listings comply with their lease agreements, housing rules, zoning laws, and all applicable local, state, and federal regulations. LeaseMe reserves the right to remove any Listing that violates these Terms or applicable law.

3.2 Verification

LeaseMe may require verification of Listings before they are publicly displayed. Verification is conducted at LeaseMe's sole discretion and does not constitute endorsement of any Listing or its accuracy. Unverified Listings are not shown to other Users.

4. Content

4.1 User Content

Users may upload text, images, and other content ("User Content"). You retain ownership but grant LeaseMe a worldwide, royalty-free license to use such content to operate and promote the Platform, including in social media posts, marketing materials, and apartment tour videos.

4.2 Prohibited Content

You may not post fraudulent, misleading, illegal, discriminatory, or infringing content. LeaseMe may remove any content that violates these Terms without notice.

5. Boost Subscription Service

5.1 Description

LeaseMe offers an optional paid promotional service ("Boost") for verified Listings. Boost provides enhanced visibility on the Platform, including placement in featured sections, a "Boosted" badge in search results, priority placement when users apply filters, and social media promotion including apartment tour videos, dedicated posts, and stories on LeaseMe's social media channels.

5.2 Eligibility

Boost is available only for Listings that have been verified by LeaseMe. The Boost option becomes available in the Edit Listing panel once a Listing is approved. LeaseMe reserves the right to decline or cancel a Boost subscription at its sole discretion.

5.3 Subscription and Billing

Boost is offered as a monthly subscription at $9.99 per Listing per month. Your subscription automatically renews each month on the billing anniversary date unless cancelled. By subscribing, you authorize LeaseMe and its payment processor to charge your payment method on a recurring monthly basis.

5.4 Cancellation

You may cancel your Boost subscription at any time through the Manage Subscription portal in your listing settings. Cancellation takes effect at the end of the current billing period — your Boost benefits remain active until that date. No refunds are issued for partial billing periods.

5.5 Social Media and Content Production

Apartment tour videos and social media content are produced and posted by LeaseMe at its sole discretion, subject to scheduling and availability. Tours are scheduled on the last week of each month starting in May and resume on a weekly schedule in Fall. LeaseMe does not guarantee specific reach, views, engagement, or outcomes from any social media content. By subscribing, you grant LeaseMe the right to film, edit, and publish content featuring your Listing.

5.6 Pricing Changes

LeaseMe reserves the right to change the Boost subscription price at any time. You will be notified of any price changes before they take effect, and continued subscription after the effective date constitutes acceptance of the new price.

5.7 No Guarantee of Results

LeaseMe does not guarantee that a Boost subscription will result in a sublease, rental agreement, increased inquiries, or any specific outcome. Boost provides promotional placement and content production only.

6. Payments and Stripe

6.1 Payment Processor

All payments for Boost subscriptions are processed by Stripe, Inc. ("Stripe"), a third-party payment processor. By subscribing to Boost, you agree to Stripe's Terms of Service and Privacy Policy in addition to these Terms.

6.2 Payment Authorization

By providing a payment method and subscribing to Boost, you authorize LeaseMe to charge that payment method for the applicable subscription fee on a recurring monthly basis. You must ensure your payment information is accurate and up to date.

6.3 Failed Payments

If a payment fails, LeaseMe may suspend or cancel your Boost subscription. You remain responsible for any outstanding amounts owed.

6.4 Refunds

All Boost subscription payments are non-refundable. No refunds are issued for partial months, unused promotional services, or early cancellation. If LeaseMe cancels a Boost subscription at its own discretion, a prorated refund may be issued at LeaseMe's sole discretion.

6.5 No Escrow or Money Transmission

LeaseMe does not hold, transmit, or escrow any funds related to rental or sublease transactions between Users. Any payments between Users are made entirely outside the LeaseMe Platform and are the sole responsibility of the parties involved.

7. Termination

LeaseMe may suspend or terminate accounts for violations of these Terms or applicable laws. Upon termination, any active Boost subscription will be cancelled and no refund will be issued for the remaining billing period. Sections relating to payments, liability, arbitration, and indemnification survive termination.

8. Disclaimers

THE LEASEME PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. LEASEME DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF FITNESS FOR A SPECIFIC PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, PLATFORM, AND ANY RELATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

LEASEME DISCLAIMS, AND USERS WAIVE ALL WARRANTIES, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

LEASEME DOES NOT WARRANT THAT THE PLATFORM OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY BOOST SUBSCRIPTION WILL PRODUCE ANY PARTICULAR RESULT.

9. Limitation of Liability

To the maximum extent permitted by law, LeaseMe's total liability shall not exceed the greater of (a) $100 or (b) the total fees paid to LeaseMe in the prior 12 months. LeaseMe is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or any Boost subscription.

10. Indemnification

You agree to indemnify and hold harmless LeaseMe, its owners, employees, and affiliates from any claims, damages, losses, liabilities, or expenses arising out of your use of the Platform, your Listings, your interactions with other Users, or your violations of law or these Terms.

11. Arbitration and Dispute Resolution

Any dispute arising from or related to this agreement or use of the LeaseMe Platform shall be resolved exclusively by binding individual arbitration under the American Arbitration Association Rules, in Miami, Florida. You expressly waive the right to participate in any class actions against LeaseMe and any of its employees, owners, or affiliates.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

13. General Provisions

These Terms and the documents referenced herein constitute the entire agreement between you and LeaseMe. If any provision is unenforceable, the remainder remains in effect. LeaseMe reserves the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
