Terms of Service

Please read these Terms of Service ("Terms") carefully as they contain important information about your legal rights, remedies, and obligations, including an agreement to resolve disputes by individual arbitration (Section 11), which you may opt out of. By creating an account or using the LeaseMe Platform, you agree to these Terms.

These Terms constitute a legally binding agreement ("Agreement") between you and Lease Me LLC, a Florida limited liability company ("LeaseMe," "we," "us," or "our"), governing your access to and use of the LeaseMe website, including any subdomains, and any other websites, mobile applications, or services through which LeaseMe makes its services available (collectively, the "LeaseMe Platform"). Our Privacy Policy and other policies applicable to your use of the LeaseMe Platform are incorporated by reference into these Terms.

1. Scope of LeaseMe Services

1.1 Marketplace Platform

The LeaseMe Platform is an online marketplace that enables registered users ("Users") to publish listings for subleases ("Listings") and to discover and communicate directly with other Users seeking short-term housing ("Guests"). Users who publish Listings are referred to as "Hosts." LeaseMe also offers a paid placement service ("Boost," Section 5) and a filmed apartment tour service (Section 15).

LeaseMe provides listing discovery, search, and messaging tools only. LeaseMe does not offer, process, hold, or facilitate bookings or reservations, and no sublease, rental agreement, or other binding arrangement is formed through the LeaseMe Platform. Messaging between Users is free, and LeaseMe does not take part in conversations between Users.

1.2 No Ownership, Brokerage, or Legal Services

LeaseMe does not own, create, sell, resell, provide, control, manage, offer, or supply any Listings. Hosts alone are responsible for their Listings. Any sublease, rental agreement, or other arrangement between Users is negotiated and entered into directly between those Users and outside the LeaseMe Platform. LeaseMe is not a party to any agreement between Users and is not a real estate broker, agent, fiduciary, landlord, tenant, or insurer. LeaseMe is not obligated to mediate any dispute between a Host and a Guest.

LeaseMe is not a law firm and does not provide legal services or legal advice. Users are encouraged to consult a licensed Florida attorney before entering into any sublease transaction.

1.3 No Guarantees

LeaseMe does not guarantee the existence, quality, safety, legality, suitability, or accuracy of any Listings, User Content, or User conduct. The verification LeaseMe performs is university email verification: it confirms that an account holder controls an email address at a participating school. It does not confirm a person's identity, that a Host holds a lease, that a unit exists or matches its photos, or that a price is accurate, and it is not an endorsement or certification. LeaseMe does not verify whether a Host has obtained any required consent from their landlord or property manager to sublet the listed property.

1.4 Independent Parties

Hosts and Guests act independently and exclusively on their own behalf. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between LeaseMe and any User.

2. Eligibility and Account Registration

2.1 Eligibility

You must be at least 18 years old and capable of entering into legally binding contracts to use the LeaseMe Platform. Use of the LeaseMe Platform is currently limited to individuals who can verify their current enrollment or recent attendance at an accredited college or university ("Student Verification"). By completing Student Verification, you represent and warrant that the information provided is accurate and complete. Providing false information to satisfy the Student Verification requirement, or using the Platform while under 18, is a material breach of these Terms and may result in immediate account suspension and potential legal liability.

2.2 Account Creation

To access certain features, you must register a LeaseMe account and provide accurate, complete, and current information. You may not register more than one account without express authorization from LeaseMe. You may delete your account at any time from your profile settings, or by contacting us through the LeaseMe Platform. Account deletion does not affect obligations arising before deletion, or the license in Section 4.1 for content already published.

2.3 Account Security

You are responsible for safeguarding your login credentials and all activity conducted through your account. You must notify LeaseMe immediately of any unauthorized access to or use of your account. LeaseMe reserves the right to share account information with law enforcement, regulators, or other government authorities as required by applicable law or legal process.

3. Listings

3.1 Host Responsibilities and Promises

Hosts are solely responsible for ensuring that their Listings comply with their lease agreements, housing rules, zoning laws, and all applicable local, state, and federal regulations. When you publish a Listing, you represent and warrant that you have, or will obtain before any sublease begins, every consent your lease or your landlord requires to sublet the unit; that you have the right to offer it; and that the Listing, including its photos, price, and dates, is accurate. LeaseMe reserves the right to remove any Listing that violates these Terms or applicable law.

3.2 Verification

LeaseMe may review Listings before they are publicly displayed. Review is conducted at LeaseMe's sole discretion, usually within a day but with no guaranteed time, and does not constitute endorsement of any Listing or its accuracy. Listings that have not been approved are not shown to other Users.

3.3 Duplicate Listings

Post each unit or room once. To change a Listing, edit it rather than posting it again. LeaseMe may remove a Listing that duplicates another.

4. Content

4.1 User Content

Users may upload text, images, and other content ("User Content"). You keep ownership of your User Content. You grant LeaseMe a worldwide, non-exclusive, royalty-free, sublicensable license to host, use, reproduce, edit, adapt, publish, and display your User Content to operate and promote the LeaseMe Platform, including in social media posts, stories, marketing materials, and apartment tour videos, and to sublicense these rights to the platforms where LeaseMe publishes that content (such as Instagram, TikTok, and Facebook) under their terms. You may remove User Content from the LeaseMe Platform at any time. The license is perpetual and irrevocable as to content already published outside the LeaseMe Platform before you removed it or deleted your account, although LeaseMe will take such content down on reasonable request where it can. You represent and warrant that you own or have the right to share your User Content, and that you have the consent of any person who appears in it.

4.2 Prohibited Content and Fair Housing

You may not post fraudulent, misleading, illegal, infringing, or discriminatory content. Under the federal Fair Housing Act and the Florida Fair Housing Act, no Listing, message, or other content may state or imply a preference, limitation, or discrimination based on race, color, national origin, religion, sex (including sexual orientation and gender identity), disability, or familial status, or any other characteristic protected by applicable law. This does not restrict lawful preferences about who will share a living space with you, such as a roommate preference for a room in a shared unit. LeaseMe may remove content that violates these Terms without notice and may suspend accounts that repeatedly do so.

4.3 Copyright Complaints

If you believe content on the LeaseMe Platform infringes your copyright, send a notice identifying the work, the content, and your contact details to support@leaseme.app. LeaseMe will respond to valid notices and may remove the content and suspend repeat infringers.

5. Boost Subscription Service

5.1 Description

Boost is an optional paid placement service for Hosts. One Boost subscription covers every eligible Listing on your account: every Listing that has been approved, is not marked leased, and has not passed its end date, including Listings approved after you subscribe. While covered, a Listing is shown first in search results and carries a "Boosted" badge, appears in the Boosted row on the home page and on the Featured page, and receives a dedicated post and story on LeaseMe's social media channels. Boost changes where a Listing appears; it does not involve LeaseMe contacting, screening, or selecting renters. Apartment tour videos are not part of Boost and are offered separately under Section 15.

5.2 Eligibility

Boost requires at least one approved Listing on your account. LeaseMe reserves the right to decline or cancel a Boost subscription at its sole discretion.

5.3 Subscription and Billing

Boost costs $9.99 per month per account, however many Listings it covers. Your subscription automatically renews each month on the billing anniversary date unless cancelled. By subscribing, you authorize LeaseMe and its payment processor to charge your payment method on a recurring monthly basis.

5.4 Cancellation

You may cancel at any time with the Cancel Boost button on any of your Listings or on the Boost tab of your profile, or through the billing portal. Cancellation takes effect at the end of the current billing period, and Boost stays on until that date.

5.5 Social Media and Content Production

Social media content included with Boost is produced and posted by LeaseMe at its sole discretion, subject to scheduling and availability, and is labelled as paid content on the platform where it is posted. LeaseMe does not guarantee specific reach, views, engagement, or outcomes from any social media content. By subscribing, you grant LeaseMe the right to produce, edit, and publish content featuring your Listings, under Section 4.1.

5.6 Pricing Changes

LeaseMe may change the Boost price. We will tell you by email at least 30 days before a new price applies to your subscription, and you may cancel before it takes effect.

5.7 No Guarantee of Results

LeaseMe does not guarantee that Boost will result in a sublease, rental agreement, increased inquiries, or any specific outcome. Boost provides promotional placement and content production only, and its price does not depend on any result.

5.8 Boost and Listing Availability

Boost bills monthly whether or not any of your Listings is currently covered. When you mark leased or delete the last Listing your Boost covers, LeaseMe asks you whether you want to cancel Boost as well, and when a Listing's end date passes, LeaseMe hides it and emails you. LeaseMe does not cancel Boost on your behalf in these situations: if you choose to keep it, it keeps billing until you cancel. Pausing a Listing does not cancel Boost. If you delete your account, Boost is cancelled immediately.

6. Payments and Stripe

6.1 Payment Processor

All payments for Boost and for the apartment tour service are processed by Stripe, Inc. ("Stripe"), a third-party payment processor. By paying for Boost or a tour, you agree to Stripe's Terms of Service and Privacy Policy in addition to these Terms.

6.2 Payment Authorization

By providing a payment method and subscribing to Boost, you authorize LeaseMe to charge that payment method for the subscription fee on a recurring monthly basis. You must keep your payment information accurate and up to date.

6.3 Failed Payments

If a payment fails, Boost stops covering your Listings until the payment goes through, and LeaseMe may cancel the subscription. You remain responsible for any outstanding amounts owed.

6.4 Refunds

Boost payments are non-refundable. There are no refunds for partial months, unused promotional services, or early cancellation. If LeaseMe cancels a Boost subscription at its own discretion and not because of your breach of these Terms, LeaseMe will refund the unused part of the current month. Refunds for the apartment tour service are governed by the Tour Service Agreement.

6.5 No Escrow or Money Transmission

LeaseMe does not hold, transmit, or escrow any funds related to rental or sublease transactions between Users. Any payments between Users are made entirely outside the LeaseMe Platform and are the sole responsibility of the parties involved.

7. Termination

LeaseMe may suspend or terminate accounts for violations of these Terms or applicable laws. Upon termination for a violation, any active Boost subscription will be cancelled and no refund will be issued for the remaining billing period. Sections 4.1, 6, 8, 9, 10, 11, 12, and 15 survive termination.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES, PLATFORM, AND ANY RELATED CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

LEASEME DISCLAIMS, AND USERS WAIVE ALL WARRANTIES, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

LEASEME DOES NOT WARRANT THAT THE PLATFORM OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT BOOST OR A TOUR WILL PRODUCE ANY PARTICULAR RESULT.

9. Limitation of Liability

To the maximum extent permitted by law, LeaseMe's total liability to you shall not exceed the greater of (a) $100 or (b) the total fees you paid to LeaseMe in the 12 months before the claim arose, and LeaseMe is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, Boost, or a tour. Nothing in these Terms limits or excludes LeaseMe's liability for gross negligence, willful misconduct, fraud, death or bodily injury caused by LeaseMe's negligence, or any liability that cannot be limited or excluded by law.

10. Indemnification

You agree to indemnify and hold harmless LeaseMe, its owners, employees, and affiliates from third-party claims, damages, losses, liabilities, and reasonable expenses arising out of your Listings, your User Content, your agreements and dealings with other Users, your violation of law, or your breach of these Terms, including the promises in Sections 3.1 and 4.1. This does not apply to the extent a claim is caused by LeaseMe's own negligence or misconduct. LeaseMe will tell you promptly about any claim it asks you to cover, will let you take part in the defense, and will not settle it in a way that admits fault on your behalf without your consent.

11. Arbitration and Dispute Resolution

11.1 Talk to Us First

Before starting any formal proceeding, you and LeaseMe agree to try to resolve the dispute informally. Send a description of the dispute and what you want to support@leaseme.app (or, for LeaseMe, to the email on your account). If it is not resolved within 30 days, either side may start arbitration or a small claims case.

11.2 Agreement to Arbitrate

Except as provided in Sections 11.3 and 11.6, any dispute between you and LeaseMe arising out of or relating to these Terms, the LeaseMe Platform, Boost, or a tour will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitrator, not a court, will decide questions about the scope, validity, enforceability, or arbitrability of this Section 11, except that a court will decide the issues in Section 11.5. Unless you and LeaseMe agree otherwise, any hearing will take place by video or in the county where you live, and fees will be paid as the AAA Consumer Arbitration Rules provide. The Federal Arbitration Act governs this Section 11.

11.3 Small Claims

Either you or LeaseMe may instead bring an individual claim in small claims court in the county where you live, if the claim qualifies.

11.4 Individual Claims Only

You and LeaseMe agree to bring claims only on an individual basis and not as a plaintiff or class member in any class, collective, or representative proceeding, and the arbitrator may award relief only to the individual party seeking it.

11.5 If the Class Waiver Fails

If a court decides that Section 11.4 is unenforceable for a particular claim or request for relief, that claim or request will be decided by a court, not in arbitration, after any individual arbitration is finished, and the rest of this Section 11 still applies to everything else.

11.6 Your Right to Opt Out

You may opt out of this arbitration agreement by emailing support@leaseme.app with your name, the email on your account, and a statement that you opt out of arbitration, within 30 days after you first accept these Terms (or, for existing users, within 30 days after this version takes effect). Opting out does not affect any other part of these Terms.

11.7 Who This Covers

LeaseMe's owners, employees, and affiliates are third-party beneficiaries of this Section 11 and may enforce it for claims against them that relate to these Terms or the LeaseMe Platform.

12. Governing Law

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles. Any claim that is not subject to arbitration will be brought in the state or federal courts for the county where you live, or in Miami-Dade County, Florida.

13. General Provisions

These Terms and the documents referenced in them constitute the entire agreement between you and LeaseMe about the LeaseMe Platform. If any provision is unenforceable, the rest remains in effect. LeaseMe may update these Terms. When we do, we post the updated Terms on this page and change the date at the top, and the change takes effect when it is posted. Check this page from time to time. By continuing to use the Platform after a change is posted, you accept the updated Terms. If you do not agree to them, stop using the Platform and delete your account. A change never applies to a claim or dispute that arose before the change was posted. A change to Section 11 (Arbitration and Dispute Resolution) takes effect 30 days after it is posted, and until then the earlier version of Section 11 applies.

14. SMS / Text Message Notifications

14.1 Program Description

LeaseMe offers an SMS notification program (the "LeaseMe Notifications" program) that sends account-related text messages to users who opt in. Messages include account notifications such as alerts about new in-app messages from other users and status updates on listings you have posted. This is a transactional notification program, not a marketing program.

14.2 Consent and Opt-In

You opt in to the LeaseMe Notifications program by providing your mobile phone number and enabling SMS notifications during account signup or in your profile settings. By doing so, you consent to receive recurring automated text messages from LeaseMe at the number provided. Consent is not a condition of purchasing or using any LeaseMe service. Message frequency varies based on your account activity.

14.3 Message and Data Rates

Message and data rates may apply. Such charges are billed by and payable to your mobile service provider. LeaseMe is not responsible for any charges imposed by your carrier.

14.4 Opt-Out and Support

You may opt out of LeaseMe Notifications at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any LeaseMe Notifications text message, or by disabling SMS notifications in your profile settings. LeaseMe will also honor any other reasonable request that clearly communicates that you no longer wish to receive LeaseMe Notifications.

After you opt out by text message, you may receive one final text message confirming that you have opted out. After that confirmation message, LeaseMe will not send additional LeaseMe Notifications to that mobile number unless you opt in again.

For help, reply HELP to any LeaseMe Notifications text message or contact LeaseMe at support@leaseme.app. Supported carriers may include AT&T, T-Mobile, Verizon, and other participating carriers. Carriers are not liable for delayed or undelivered messages.

14.5 Privacy

LeaseMe uses your mobile telephone number and SMS opt-in information solely to operate and administer LeaseMe Notifications and related account communications. LeaseMe does not sell, rent, or share your mobile telephone number or SMS opt-in consent with third parties or affiliates for their marketing or promotional purposes. LeaseMe may share such information with service providers solely as necessary to operate the LeaseMe Notifications program. 14.6 Tour Scheduling Calls and Texts

Calls and texts to schedule an apartment tour are separate from the LeaseMe Notifications program. They are sent only to tour customers who agree to them at tour checkout, and are governed by the Tour Service Agreement.

15. Apartment Tour Service

15.1 Description

LeaseMe offers a filmed apartment tour as a separate service for a one-time fee of $29.99. When you reserve a tour, the LeaseMe team films a walkthrough of the unit and posts the video to LeaseMe's social media channels. A tour is not part of Boost and does not require a LeaseMe account or Listing.

15.2 Tour Service Agreement

Every tour is governed by the Tour Service Agreement, which the customer accepts at checkout, including customers who have no LeaseMe account ("Tour Customers"). It covers scheduling, access and permission to film, filming rules, use of the video, refunds, and liability. If you have an account, these Terms also apply; if they conflict about a tour, the Tour Service Agreement controls.

15.3 Where Tours Are Offered

Tours are currently offered only near the campuses LeaseMe serves in Gainesville and Tallahassee, which are the University of Florida, Santa Fe College, Florida State University, and Tallahassee State College. Tours are not available in Miami at this time.

15.4 Refunds

The tour fee is refundable in full any time before the tour has been filmed. To cancel, contact support@leaseme.app before your scheduled tour. Once the tour has been filmed, the fee is non-refundable.
